Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 11 months for alleged recovery of 23.55 kgs. of ganja. The investigation of the case has been concluded and charge-sheet has already been submitted before the learned special court.

Learned advocate for the State opposes the prayer for bail and submits that charges have already been framed, witness action has commenced and the next date has been fixed for crossexamination of C.S.W.1. There are antecedents of the present petitioner, as such, release of the petitioner would open the scope of commission of offence.

I have taken into account the earlier cases which are of

the year 2014 and 2019 and the said cases are under the Indian Penal Code.

Having considered the nature of the case and similarly placed accused person has been granted bail, I am inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sk Ansar Ali shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional Sessionst Judge, 3rd Court, Howrah. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Howrah without the prior permission of the learned special court.

Accordingly, CRM (NDPS) 137 of 2026 is allowed. Memo of Evidence and report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
