Petitioners are aggrieved by the fact that the relations are objecting to water connection being supplied to the petitioners. To that effect, information have been furnished to the police authorities, but no action has been taken.
Mr. Ahmed, learned advocate appearing for the State has submitted a report. Report reflects that the Public Health Engineering Department had sanctioned the water connection and proceeded to implement the scheme but the villagers raised objection claiming that the installation of the water tap beside the public place in stead of their own place would cause damage to the road and obstruct the pedestrian movement.
If the PHE Department had sanctioned the water connection for implementing the scheme, the police authorities would ensure that there is no breach of the peace at the time when the connection which has been sanctioned under the scheme is implemented. No untoward incident should arise because of the inimical relationship between the parties. Water being an essential service, in case the same is disrupted, police authorities would draw appropriate proceedings against the persons, adhering to the provisions of law.
With the aforesaid observations, WPA 776 of 2025 is disposed of.
There will be no order as to costs.
Report submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
