4. Vide the impugned order the trial Court has been pleased to reject the opposite party/petitioner's prayer to file written objection against the

original application on the ground that the several opportunities were granted to the opposite party/petitioner herein and also that no accommodation has been prayed for.

5. Considering the said fact and in the interest of justice the order under challenge dated 6.12.2023 passed by the learned Additional District Judge, 3rd Court FTC, Alipore passed in Act -VIII case No. 94 of 2022 is modified to the following extent that the opposite party/petitioner shall be permitted file his written objection to the main application under Section 25 of the Act within 15 days from the date of this order and the trial Court shall accept the same and proceed with the case in accordance with law expeditiously .

6. The civil revision being CO No.

84 of 2024 along with the CAN 1 of 2025 stands disposed of.

7. Urgent Photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings.
