Affidavit of service filed in Court today is taken on record.

The petitioners allege that the Public Health Engineering Directorate is illegally encroaching upon the raiyati agricultural land of the petitioners and trying to construct a water tank.
3.
An objection was filed before the respondent authorities in December 2024 but the same is alleged to be kept pending.

Without entering into the merits of the allegation of the petitioners as it appears that the representation filed by the petitioners is pending consideration at the end of the authority, accordingly, the instant writ petition is disposed of by directing the District Magistrate, Purba Medinipur to consider the objection filed by the petitioners strictly in accordance with law, at the earliest but positively within a period of eight weeks from the date of communication of this order.

The District Magistrate shall cause a spot inspection with the aid and assistance of the Block
Land and Land Reforms Officer, Nandigram-III to ascertain as to whether the allegation of the petitioners is proper or not.

If it appears that the allegation of the petitioners is correct, then necessary remedial steps shall be taken.

Learned advocate for the petitioners is directed to forward a copy of the representation along with all supporting documents to the District Magistrate and the Block Land and Land Reforms Officer, Nandigram-III for taking steps in compliance of the direction passed hereinabove.

The writ petition stands disposed of.
9.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
