Mr. Souma Shbhra Roy Mr. Arijit Roy Ms. Neelam Kumari Ms. Priyanka Patra ...for the Petitioner The petitioner herein has prayed for a direction upon the court below for expeditious disposal of the proceeding being GR Case No. 1240 of 2017 presently pending before the learned Judicial Magistrate, 1st Court, Barasat.

Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the FIR was lodged on 4th February, 2017 and the investigating officer submitted charge-sheet on 22.03.2017. Learned court below framed charge on 23.09.2019 but no witness has been examined so far on behalf of the prosecution and the matter is unnecessarily prolonging. Prosecution proposes to examine five witnesses. In such circumstances, he sought for a direction upon the court below for expeditious disposal of the case.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered the submissions made by the learned counsel for the petitioner and that the matter is pending for examination of the witnesses for a considerable period of time since September 2019, I find that the prayer made by the petitioner is justified and is required to be allowed for the ends of justice. Therefore, the instant application being CRR 154 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the proceeding being GR Case No. 1240 of 2017 and to make his best effort to conclude the trial without granting any unnecessary adjournments to either of the parties preferably within a period of six months from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
