In Re: An application for bail under Section 439 of the code of Criminal Procedure, 1973 filed on 6th January, 2023 in connection with G. R. Case No. 3176 of 2022 arising out of Lalgola Police Station Case No. 344 of 2022 dated 25.09.2022 under Sections 27/28/28A of the Drugs and Cosmetics Act.

Report of the CFSL, Kolkata regarding forensic examination report submitted through the learned advocate for the State be kept with the record.

The report of the chemical examiner reflects that no narcotic drug was detected in the content of the materials, which were seized by the Police Authorities in course of the investigation. Considering the aforesaid fact, the interim bail which was granted on 9th February, 2023 and is subsisting till 14th March, 2023 is hereby confirmed.

The conditions so imposed on 9th February, 2023 while granting interim bail would be modified as follows:-

1. The petitioner shall be physically available before the learned court on each and every date so fixed for the trial of the case.

2. Any change of address of the petitioner should be informed to

the learned Additional Chief Judicial Magistrate, Lalbag as well as the Officer-in-Charge/Inspector-in-Charge of the Lalgola P.S.

3. Any other condition as the learned Additional Chief Judicial Magistrate, Lalbag deems fit and proper.

With the aforesaid observations, the application for bail being CRM (SB) 20 of 2023 is allowed.
