No.32 CRR 74 of 2021 In the matter of : Nur Islam @ Islam @Noor Islam Mr. Nilendra Narayan Ray Mr. Kaushik Biswas ........ for the petitioner Mr. Swapan Banerjee Ms. Purnima Ghosh .... for the State Although this is an application for quashing of a proceeding under Sections 379, 411, 413 and 414 read with Section 34 of the Indian Penal Code, learned counsel appearing on behalf of the petitioner submits that the petitioner would not like to press for the same and would, instead, pray for stay of warrant of arrest issued against him.

Learned counsel for the petitioner further submits that after obtaining bail in the present case, the petitioner was regularly attending Court. On one occasion the petitioner could not take steps before the learned trial court and a warrant of arrest was issued on 08.03.2019. The same has remained pending. The petitioner would like to join the proceeding at the earliest. I have heard the learned advocates for the petitioner and the State and have perused the revision petition. The petitioner is directed to surrender before the learned trial court within four weeks from this date. The warrant of arrest issued against the petitioner shall remain stayed for a period of four weeks.

In the event the petitioner surrenders before the learned trial court within the said period of four weeks and prays for bail, his application for bail shall be considered in accordance with law. With these observations, the revisional application is disposed of.
