The petitioner claims that private respondents and the police are preventing her from cultivating paddy on a land in which she has tenancy rights.

This Court is of the view that the Executive Magistrate under the Cr.P.C. can intervene only for the limited purpose of maintaining public law and order and peace.

Parties are required to agitate their civil rights in respect of property before an appropriate civil forum.

The officer-in-Charge, Ganga Sagar Coastal P.S. shall however ensure that there is no breach of peace in the area.

Affidavit-of-service filed by the petitioner is kept with the record.

The writ petition stands disposed of.

However, there shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official wesbite of this Court.
