Mr. Rahul Deb Goenka ..for the Petitioner Mrs. Pramiti Bandopadhyay Mr. Akash Dutta ...for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. The petitioner who is an octogenarian person alleges torture and assault by the private respondents who are his son, daughter in law and grandson respectively. The petitioner has been compelled to stay in an oldage home due to continuous threats by the private respondents and has lodged a complaint in this regard before the police authority on November 10, 2025 which has not been considered. The petitioner seeks to return to his own house and reside there peacefully.

It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner enquiry was held and the complaint was diarised. The 6th respondent has lodged a complaint against the petitioner which has also been diarised.

Admittedly the petitioner is the owner of the house in question where the private respondents reside. The private respondents can at best be termed as licencees under the petitioner. The petitioner is at liberty to take necessary steps for their eviction therefrom in accordance with law.

In the meantime, the Officer in Charge, Haridevpur Police Station being the 3rd respondent herein, shall render necessary assistance to the petitioner so that he is able to return to his house and stay there peacefully. The petitioner shall approach the 3rd respondent and indicate the date and time of his intended return to his house. The 3rd respondent shall provide necessary protection/assistance to the petitioner so that he is able to return to his house and reside there peacefully and safely. The police shall keep strict vigil in the area and shall ensure that the petitioner is able to reside in his house safely and peacefully without any disturbance from any corner whatsoever including the private respondents. The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
