21.09.2023 sdas rejected C.R.M.(NDPS) No. 35 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Swarupnagar Police Station Case No. 110 of 2022 dated 09.02.2022 under Section 21(c ) of the NDPS Act.

And In Re : Amirul Mondal alias Chotta .... petitioner Mr. Angshuman Chakraborty ....for the petitioner Mr. Ranabir Roy Choudhury Mr. Sandip Chakraborty ...... for the State

1. Chemical report has been placed before the trial court.

2. Report shows presence of codeine phosphate. Materials on record shows recovery of 10 liters of codeine phosphate from the petitioner which is above commercial quantity.

3. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
