For the Petitioners Ms. Parna Roy Chowdhury Mr. Avishek Choudhury ...For the Punjab National Bank Ms. Swarnalekha Auddy Mr. Surajit Auddy ..For the Respondent Nos. 4, 5, 7 to 10 Mr. Saha, learned counsel appearing on behalf of the petitioners undertakes to pay the deficit Court fees in course of the day. In default, the writ petition shall stand dismissed. The claim of the writ petitioners is that they are not getting the Dearness Allowances that the other employees of the Punjab National Bank are getting in the Ex-Servicemen Category. The petitioners have all been appointed in the ExServicemen category. It appears that the reason for not receiving D.A. on defence pension was production of a Certificate before the bank regarding non-availment of D.A. in the pension amount.

Mr. Saha submits that such an undertaking was given by the petitioners due to their wrong understanding of the fact that they would be entitled to pay protection in the event the D.A. in their pension amount was not availed of. He prays for consideration of the representation of the petitioners dated August 10, 2022.

Ms. Choudhury, learned counsel appearing on behalf of the bank submits that the representations may be considered in accordance with the extant Rules/Policies/Guidelines of the bank.

Ms. Auddy, learned counsel represents the State Bank of India.

In the light of the submissions made hereinabove, let the representation dated August 10, 2022 issued by the Advocate on behalf of the petitioner be considered by the Chief Manager (Personnel Admin Award Staff)/the respondent no. 11 within eight weeks from date upon giving a personal hearing to the petitioners. The representation will be disposed of by a reasoned order and the same will be communicated to the petitioners within two weeks of passing thereof.

With the directions aforesaid, W.P.A. 655 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the writ petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
