For the State On the basis of a complaint filed by the respondent No. 5, a case has been started against the petitioner being Beniapukur Police Station Case No. 353 dated September 18, under Sections 341/324/506/114 of the Indian Penal Code. On the basis of the complaint filed by the petitioner, another case being Beniapukur Police Station Case No. 354 dated September 18, under Sections 341/324/506/379/114 of the Indian Penal Code has been started against the respondent Nos. 5 and 6. Investigation in respect of both the cases are pending. During enquiry, the police authorities came to learn that the dispute was over disconnection of the electricity line in the tenanted premises occupied by the petitioner and stoppage of the use of a portable

generator set. There are disputes with regard to nonpayment of licence fees, by the petitioner. The allegation of the petitioner, that the electricity supply line was wrongly disconnected, has to be adjudicated by the appropriate authority. Such question is left open to be determined by the appropriate forum. With regard to the investigations, which are pending, the police authorities shall reach the same to their logical conclusion. A vigil shall be maintained in order to ensure that further altercations do not take place between the parties.

The writ petition is thus disposed of.

There shall be no order as to costs.
