Petitioner is aggrieved by the fact that the 15.07.2025 Court No. 35 M/L. No.757 Rakib petitioner being a member of an opposition political party was subjected to physical assault and was admitted to hospital. Surprisingly, the police authorities did not act on the representation of the petitioner, on the contrary acted on the false accusation made by the private respondents. Such information was furnished to the Inspector-in-Charge of Nabadwip Police Station as also the Superintendent of Police on or about January, 2024. Since, none appears on behalf of the State, Ms. Mahuya Dutta Biswas, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Having considered the fact that substantial time has passed and the petitioner's grievance still persist, I direct that if till date no criminal case has been registered, petitioner would be at liberty to approach the jurisdictional Magistrate. The Jurisdictional Magistrate

will asses and ascertain regarding the veracity of the accusations and thereafter pass necessary direction as he deems fit and proper.

With the aforesaid observations WPA 632 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
