Learned advocate appearing for the petitioner submits that the petitioner has been implicated for alleged recovery of 500 bottles of phenseydl and is in custody for 1 year 1 month. Petitioner has enclosed the copy of the evidence in respect of the four witnesses which has been recorded in connection with the instant case.

Learned advocate for the State opposes the prayer for bail.

I have considered the depositions of P.W.1 and P.W.2 and the period of detention of the present petitioner and on an assessment of the same, I am of the view that further detention of the petitioner, at this stage, is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Joni Mondal @ Sukur @ Jani Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Nadia without the prior permission of the learned special court. If there is any violation of the aforesaid conditions, learned trial court would cancel the bail of the petitioner without further reference to this Court.

Accordingly, CRM (NDPS) 90 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
