19.02.2025 rc/ct.no.34 Item No.61 CRR No. 162 of 2025 In the matter of : Sri Samir Pal .......Petitioner Mr. Angshuman Chakraborty Mr. S.S.Saha ...for the Petitioner The petitioner is aggrieved by the observation made by the learned Additional District and Sessions Judge, Fast Track, 3rd Court, Alipore, South 24 Parganas in judgment and order dated November 25, 2024 in Criminal Appeal No. 211 of 2023 that "arrears towards the monetary relief and residence order (monthly rent) is to be paid/deposited within January 31, 2025. If any amount has already been paid/deposited towards monetary relief or residence order, the same amount is to be set off." Learned counsel for the petitioner submits that considerable amount of the arrear monetary relief has been paid by the petitioner.

The petitioner seeks grant of installments to clear the remaining amount since he is not capable of clearing the entire arrear amount within January 31, 2025. The petitioner seeks to withdraw the revisional application and approach the learned Appellate Court/the learned Additional District and Sessions Judge, Fast Track, 3rd Court, Alipore with an application seeking such installments.

The relevant portion of the order dated November 25, 2025 as stated above be stayed till disposal of the application intended to be filed by the petitioner. If such application is not filed within stipulated timeframe, the interim order of stay shall stand automatically vacated.

CRR No. 162 of 2025 is dismissed as withdrawn. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
