Petitioner is aggrieved by the fact that in spite of informing the police station regarding missing of documents and articles after breaking the padlock of a room at the behest of the private respondents, Beliaghata Police Station did not register any case rather they reduced the substance of the accusations as Beliaghata PS GDE No. 3215 dated 27.07.2024. Report submitted by the state reflects that some enquiry was done by the police authorities. Without entering the findings of such enquiry, I grant liberty to the petitioner to approach the jurisdictional court by invoking the provisions of section 175(3) of the BNSS.

It would be the discretion of the jurisdictional court to act in accordance with law and pass necessary directions under the relevant provisions. With the aforesaid observations WPA 828 of 2025 is disposed of.
