Learned advocate appearing for the petitioner submits that petitioner is in custody for one year three months and the accusations against the present petitioner is for alleged recovery of 100 pieces of Rs.500/- denomination stated to be FICN. It has also been contended that similarly placed accused person has already granted anticipatory bail.
Learned advocate for the State opposes the prayer for bail and submits that another accused person is absconding which has contributed to the delay. The case has already been committed to the Court of Sessions and if the petitioner is released on bail the whole of the trial would be jeopardized.
I have taken into account the materials available in the Case Diary and the stage of the case and charges are yet to be framed. Accordingly, I direct the learned trial Court that if all the accused persons are not available it would exhaust the process of law and
proceed with the consideration of charges so far as the present petitioner is concerned.
At this stage, the prayer for bail of the petitioner in CRM (M) 163 of 2026 is dismissed.
