Affidavit of service filed in Court today is taken on record.

The writ petitioner no.1 is aggrieved that the Bhadreswar Police Station has not taken any steps with regard to his complaint dated November 3, 2021.

It is submitted by the counsel for the State that since after receiving the petitioner's complaint, proceedings have been registered in cognizable cases, inter alia, under Sections 107/116(3) of the Cr. P.C. dated October 27, 2021. In respect of another complaint dated October 29, proceedings under Section 506 of the IPC have also been registered.

It is also submitted that the mother has lodged complaint against the petitioner no.1 which has resulted in charge sheet being No. 447/2021

dated November 30, 2021 being filed under Sections 448/323/324/506/34 IPC.

The petitioner no.1 claims that the property in question where the mother is located is in the name of his father and he has a share therein out of the house. The petitioners may take out appropriate civil proceedings against the property in question and the mother.

Since the petitioner claims that his belongings are still lying in the said house, the Officer-in-Charge, Bhadreswar Police Station shall accompany the petitioners and assist them in taking out their belongings from the said house. The petitioners may live separately subject to the result of any civil proceedings as indicated hereinabove.

It is expected that the removal of belongings of the petitioners shall be completed within 10 days from date.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
