Mr. Mukherjee, learned advocate appearing for the petitioners submits that inadvertently instead of preferring an appeal under the relevant provisions of the Protection of Women from Domestic Violence Act, 2005, a revisional application has been preferred before this Court and as such, he does not intend to proceed with the same.
I find that the order under challenge is of the year 2017 and the revisional application was affirmed on January 2021. If an appeal is preferred, the learned appellate court would only consider the period of limitation for the last 11 months. Thus, CRR 80 of 2021 is dismissed as not pressed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
