Heard the learned counsels for the parties.

Perused the case diary.

The prosecution case is that the petitioners and other accused persons assaulted 6 to 7 persons. Some of the injuries caused were cut injuries over vital parts of the body like head and fracture of arm. Considering the above, the other materials available in the case diary and the alleged roles ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner nos. 1, 3, 7, 12, 14, 15 and 16 (Mofajjel Dhali, Bapiya Dhali, Latif Dhali, Alauddin Dhali, Habibar Dhali, Nuro Box Mollick and Sahib Molla @

Sahid Ali Sanpui), the application for anticipatory bail of the petitioner nos. 2, 4, 5, 6, 8, 9, 10, 11 and 13 is rejected. Accordingly, the application for anticipatory bail of the petitioner nos. 1, 3, 7, 12, 14, 15 and 16 is allowed.

In the event of arrest, the petitioner nos. 1, 3, 7, 12, 14, 15 and 16 (Mofajjel Dhali, Bapiya Dhali, Latif Dhali, Alauddin Dhali, Habibar Dhali, Nuro Box Mollick and Sahib Molla @ Sahid Ali Sanpui) shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner nos. 1, 3, 7, 12, 14, 15 and 16 shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The petitioner nos. 1, 3, 7, 12, 14, 15 and 16 shall meet the I.O. once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
