...for the respondent The learned Counsel for the parties have jointly submit that the subject matter of the appeal has been amicably settled out of Court and the appellants have already delivered the vacant and peaceful possession of the suit premises in favour of the plaintiff and none of the parties have any claim against each other.

The original letter of instruction dated 18th February, 2022 addressed to Mr. Souradipta Banerjee, Advocate is kept with the record.

The parties are at liberty to withdraw the original documents filed in Title Suit No. 4302 of 2009 before the trial court after furnishing the photostat copies of such of the documents.

The LCR may be forthwith sent down to the learned 10th Bench, City Civil Court at Calcutta by the special messenger at the costs of the respondent.
