1. Affidavit of service filed in Court today is taken on record.

2. Report filed by the Inspector-in-Charge, Kakdwip Police Station signed on 24th January, 2022 be retained with the records.

3. The petitioner alleges that the private respondents are illegally and unauthorizedly encroaching the public road and blocking the free ingress and egress of the petitioner. An objection was filed before the Executive Engineer PWD (Roads), but the same is yet to be considered and dispose of.

4. None appears on behalf of the private respondents.

5. As it appears that, the objection filed before the Executive Engineer PWD (Road) being the respondent no. 4 herein is pending consideration for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the respondent no. 4 to take steps in response to the complaint lodged by the petitioner, in accordance with law after giving reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order.

6. The said order shall be communicated to all the parties, immediately thereafter.

7. Steps shall be taken in the matter at the earliest, but positively within a period of eight weeks from the date of communication of this order.

8. If it appears that the allegation of the petitioner is proper, then consequential steps for removal of the unauthorized encroachers shall be taken.

9. Learned advocate for the petitioner is directed to forward a copy of the objection filed by the petitioner to the aforesaid respondent at the time of communicating the order of this Court.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
