The prayer of the petitioner is that the Sub-Divisional Officer, Murshidabad has not disposed of the application filed under Section 11(1)(d) of the West Bengal Panchayat Act, 1973. The petitioner has filed the application sometime in December 28, 2021. It is alleged that the said application is still pending.

Without going into the merits of the allegation levelled against the respondent nos.7 and 8 and the prayer for their removal, the writ petition is disposed of with a direction upon the Sub-Divisional Officer, Murshidabad to dispose of the application of the petitioner in accordance with law. Point of maintainability of the said application is kept open. All the issues shall be decided by the said authority upon hearing the parties. A reasoned order shall be

passed and communicated to all concerned. The complaint lodged before the said authority shall be supplied to the respondent nos.7 and 8. All parties shall be entitled to file their written versions.

The entire exercise shall be completed within a period of two months from date of communication of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the learned advocate's communication.
