Affidavit-of-service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks direction upon the respondent authorities for his intra district transfer to a school nearby his residence at Machibhanga in Bhangore North Circle under District Primary School Council, South 24-Parganas upon consideration of his representation dated 5th October, 2024.

The petitioner contends that he is an Assistant Teacher of Golanari F.P. School, P.O. Manirtat, under Canning Circle, District-South 24-Parganas. The petitioner joined the said school on 20th July, 2021. The petitioner has completed the mandatory probation period.

The petitioner has to travel more than 75 kms. to attend school from his residence. The petitioner has two minor

children and his wife and parents are suffering from various ailments. On 5th October, 2024, the petitioner made an application before the Chairman, District Primary School Council, South 24-Parganas seeking transfer.

However, the same is still pending consideration. Hence, this writ petition.

Mr. Shamim ul Bari, learned Advocate for the petitioner submits that specific direction be issued upon the Chairman, District Primary School Council, South 24Parganas for consideration of representation of the petitioner dated 5th October, 2024 for his transfer. 5.

Mr. Gourav Das, learned Advocates for the District Primary School Council, South 24-Parganas submits, at the outset, that filing of report may not be necessary in the event the matter is relegated to the appropriate authorities for taking a decision on the representation of the petitioner.

In view of such submissions advanced on behalf of the respective parties, respondent No.5, Chairman, District Primary School Council, South 24-Parganas is directed to consider the representation of the petitioner dated 5th October, 2024 and dispose of the same by passing a reasoned order, in accordance with law, upon notice to the petitioner, within a period of eight weeks from the date of communication of this order.

The reasoned order shall be communicated to the petitioner within a week from the date of passing of such order.

Learned advocate for the petitioner is directed to communicate this order to respondent No.5, Chairman, District Primary School Council, South 24-Parganas, for necessary compliance.

With the above direction, the writ petition being WPA 814 of 2025 stands disposed of.

10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

11. Interim order, if any, stands vacated.

12. All connected applications, if any, stand disposed of.

13. There shall be no order as to costs.

14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
