Mr. Parimal Kumar Pahari, learned Counsel representing the appellant has fairly submitted that the special messenger costs was deposited on 13th December, 2022 beyond the time indicated in our order dated 25th November, 2022. However, there is no reflection in the report filed by the department concerned regarding such deposit being made on behalf of the appellant. The Acknowledgement Slip showing receipt of such amount by the department on 13th December, 2022 is produced before us. The delayed deposit shall be regularized.
The department shall take up immediate steps for bringing the L.C.R. and the other formalities shall be completed in order to make the appeal ready for hearing.
A Photostat copy of the receipt issued by the Central Dispatch Section dated 13th December, 2022 being Serial No.G-203 dated 13th December, 2022 is kept with the record.
The application for substituted service being Filing No.1 of 2022 dated 15th December, 2022 shall be
placed before the Lawazima Bench for appropriate order.
