Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the sister-in-law, the mother-in-law and the aunt-in-law, respectively of the alleged victim. The husband and the father-in-law were arrested and are in custody. The incident took place 11⁄2 years after the marriage. The petitioners have been falsely implicated in this case.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statements of witnesses including of neighbours and the post-mortem report. 3.

From the post-mortem report it appears that other than the ligature mark, there were bruises on the right leg, left leg, left knee joint and left scapular region. From the statements of neighbours it appears that they had witnessed assault being committed on the victim on the particular day by the petitioner nos.2, 3, the husband, the father-in-law and some others.

Considering the above, the materials available in the case diary and the alleged role ascribed to each of the present petitioners while I am inclined to grant anticipatory bail to petitioner no.1, the application for anticipatory bail of the petitioner nos.2 and 3 (Mondal Fiddusa Bibi and Runa Laila Khatun Bibi) is rejected.

In the event of arrest, the petitioner no.1 (Dil Aktar Banu @ Dilaktar Banu) shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner no.1 shall cooperate with investigation and shall not threaten and/or intimidate witnesses. 6.

The application for anticipatory bail is, thus, disposed of. 7.
