20.01.2022 sayandeep Sl. No. 04 Ct. No. 05 WPA 631 of 2022 [Via Video Conference] Durgapur HIMU Educational and Welfare Society -Versus- State of West Bengal & Ors.

Mr. Biswaroop Bhattacharya Mr. Avik Ghatak Ms. Deblina Chattaraj Ms. Afreen Begum ...... for the petitioner Mr. Rajat Dutta ..... for the State Mr. Nilotpal Chatterjee ...... for the INC Mr. Amitava Chaudhuri Mr. N. Roy ..... for the respondent No. 8 The grievance of the writ petitioner, which is an Institute of Nursing in Medical Sciences, is that the total number of seats was reflected in the website of the Central Selection Committee(Nursing), as on 5th January, 2022, was suddenly reduced on 6th January, 2022 without any indication or reason for the same. The seats were ineffectively reduced from 58 to 17 in the course of a day. According to learned counsel appearing for the petitioner, the petitioner has complied with and completed all the statutory

formalities for starting a course on the concerned subjects for the present academic year.

Learned counsel appearing for the State submits on instructions that the reduction in the number of seats was wrongly done and that the error will be corrected before the next Mop-up round of counselling.

Upon hearing learned counsel, this Court is of the view that the correction should be done in the earliest possible time since otherwise the petitioner will lose valuable time in opportunity. The respondent No. 7 being the Central Selection Committee (Nursing) is accordingly directed to correct the error and indicate the number of seats which were reflected as on 5th January, 2022 on the website within 48 hrs. from today.

WPA 631 of 2022 is disposed of in terms of the above order.

The respondent No. 8 is represented.
