The petitioner prayed for appointment on compassionate grounds since his father died-in-harness on May 7, 2021. It is the case of the petitioner that though he possessed the minimum educational qualification as required by the West Bengal State Electricity Development Corporation, (WBSEDCL) rejected the prayer of the petitioner on July 14, 2022.
It is submitted by Mr. Mondal, learned counsel appearing on behalf of the petitioner that since the petitioner did not pay his school fees, a copy of attendance register or school leaving certificate was not handed over to him and he could not produce the same before the respondent Corporation.
Mr. Chattopadhyay, learned counsel appearing on behalf of the respondents/WBSEDCL submits that despite
having opportunity, the petitioner failed to provide any document evidencing the minimum educational qualification. He also draws the attention of this Court to the Recruitment Policy of 2010 in support of his contention that the petitioner was an ineligible candidate.
Considering the submissions of the parties and the materials placed on record, this Court is of the view that there are no pleadings to the effect that the petitioner had attained the minimum educational qualification as required by WBSEDCL. There is also no allegation with regard to the school concerned is not issuing a certificate with regard to the educational qualification of the petitioner since the petitioner was unable to pay the necessary fees. The only allegation is that no personal hearing was given to the petitioner. In the light of the discussions above, this Court is of the view that there is no merit in the petitioner's prayer for compassionate appointment since the petitioner failed to provide supporting documents as required by the respondent Corporation in respect of the compassionate appointment. There is no perversity, arbitrariness or capriciousness in the decision making process of WBSEDCL.
In such view of the matter, W.P.A 709 of 2023 is dismissed.
