Antu Sk @ Jin Sk @ Jin and another ... Petitioners.

Learned advocate appearing for the petitioners submits that petitioners are similarly situated as the other accused person who has been granted bail and they as such may be granted the same privilege.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 100 bottles of phensedyl were recovered at the instance of the petitioner no.1. Learned advocate for the State submits that there are antecedents of the present petitioners and the petitioner no.1 has been implicated in a case under the Indian Penal Code.

Having considered the fact that pursuant to the statement of the petitioner no.1, another 100 bottles of phensedyl were recovered and that both the petitioners are

in custody for about 11 months, I am of the opinion that further detention of the present petitioners are unwarranted. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Antu Sk @ Jin Sk @ Jin and 2. Alim Sk @ Elim Sk shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional District Judge, 3rd Court, Malda. If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 99 of 2026, is, thus, disposed of.
