The application for bail under section 439 of the Code of Criminal Procedure in connection with Kotwali P.S. Case No. 144 of 2019 dated 12.03.2019 under sections 498A/302/34 of the Indian Penal Code has been filed by the petitioner. The learned advocate appearing for the petitioner submits that the marriage between the petitioner and the deceased was solemnized about 11 years ago. Upon completion of investigation, charge sheet has also been filed and, as such, further detention of the petitioner, who is in custody for 682 days, is not necessary.

The learned advocate appearing for the State opposes the petitioner's prayer and draws our attention to several documents in the case diary.

Having heard the learned advocates and upon considering the materials in the case diary, the post-mortem report, we are not inclined to grant bail to the petitioner. Accordingly, the application of bail, being CRM No.320 of 2021, is rejected.
