Affidavit of service so filed be kept with the report. Report submitted by Mrs. Manisha Sharma, learned advocate appearing for the State be kept with the record. Petitioner was granted anticipatory bail vide CRM 3843 of 2020 for a period of three months. The finding of the Division Bench was that as no narcotic substance was recovered from the possession of the petitioner, he should be granted the privilege of anticipatory bail, although the same was for a limited period. Learned advocate submits that the warrant of arrest has been issued against the petitioner. Having considered the fact that the petitioner was granted anticipatory bail, but failed to appear before the court subsequently as during the relevant period covid19 pandemic and its restriction was existing, I am of the view that the execution of the warrant of arrest issued by the learned Additional District and Sessions Judge, 2nd court Berhampore, Murshidabad arising out of Burwan P. S. Case No. 97 of 2020 be stayed till 8th March, 2024.
In case the petitioner appears and surrenders within the aforesaid period, the learned trial court would take into account that the petitioner was granted anticipatory bail by a Division Bench and dispose of the bail application in accordance with the law.
With the aforesaid observations, the revisional application being CRR 112 of 2024 is disposed of.
