The petitioner is the husband of the de facto complainant. Having heard the learned Advocate for the petitioner and the learned P.P.-in-Charge, it is ascertained that allegation has been made against the petitioner under Section 498A/323 of the Indian Penal Code. There are other allegations made by the de facto complainant against other matrimonial relations, which do not attract

against the present petitioner. He is in custody for 38 days.

Considering the period of detention and stage of investigation, I am inclined to release the petitioner on bail. The petitioner is granted bail of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each of like amount to the satisfaction of the learned Special Judge, POCSO Court, Howrah and on further condition that during trial, the petitioner must be present in Court on all occasions, failing which the order of bail shall be cancelled without further reference to this Court.
