dismissed that the petitioner no.1 is in custody for 11⁄2 years and the petitioner no.2 has been arrested in the month of November, 2025 and since then he is in custody.

So far as the complicity of the present petitioners are concerned, from the statement of the witnesses primarily reflected that the petitioners are the only two accused persons who were involved in assaulting the deceased. Charge has recently been framed and witness action is yet to commence. Having considered the stage of the case, I am of the opinion that it would not be fit and proper to release the petitioners on bail at this stage. State is directed to put in efforts for expediting the witness action.

At this stage, CRM (M) 267 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
