Heard Ms. Ashmi Pradhan, learned Counsel for the appellant.

Affidavit-of-service filed by her is taken on record but the tracking report shows that notice was not delivered on the respondent. It is also submitted by her that in spite of best effort she has not been able to establish contact with the appellant, therefore, she records no instructions.

In view of such fact, the appeal being FA 39 of 2005 stands dismissed.

Interim order, if any, stands vacated.

5.

L.C.R. if arrived in the meantime be returned to the trial court.
