Learned advocate for the petitioner submits that the petitioner intends to liquidate the loan amount by way of five monthly installments.

It appears from the documents annexed to the writ petition that the petitioner is yet to submit any application before the Board of Directors with his above prayer.

In view of the above, it will be open to the petitioner to apply before the Chief Executive Officer,

Contai Cooperative Agricultural and Rural Development Bank Limited with his prayer. If such application is made the Chief Executive Officer shall place the application of the petitioner before the Board of Directors for taking a decision in the matter. The decision shall be taken at the earliest but positively within a fortnight from the date of filing the representation.

The writ petition is disposed of.
