Mr. Rajesh Singh ...For the Appellant Mr. Jayanta Kumar Mandal ...For the Claimants/Respondents The Instant appeal is directed against the judgment and award dated May 31, 2016 passed by the learned Additional District & Sessions Judge, Motor Accident Claims Tribunal, 1st Court, Barasat, North 24-Parganas in MAC Case No. 3234 of 2014/31 of 2011.
Mr. Rajesh Singh, learned Counsel appearing on behalf of the appellant Insurance Company on instruction submits in Court today that his client/Insurance Company does not wish to pursue the instant appeal any further. He further submits that a sum of Rs.25,000/- being the statutory amount along with a sum of Rs.4,03,476/-, consolidated amount of Rs.4,28,476/-, have been deposited in terms of the Court's order dated January 6, 2017 with the learned Registrar General of this Court. He submits that the above consolidated amount may be disbursed to the claimants in accordance with law as per the award.
In the light of the above submissions, the claimants/respondents shall furnish particulars of their respective bank accounts as also proof of identity with the Registrar General of this Court as expeditiously as possible. Upon deposit of such details, the Registrar General is directed to pay the consolidated amount deposited along with any accrued interest to the claimants/respondents in accordance with law as per the award within a period of four weeks. The Registrar General shall check the veracity of the bank accounts and the identity of the claimants before disbursing the amounts.
With the aforesaid directions the instant appeal is disposed of.
Mr. Jayanta Kumar Mandal, learned Counsel appearing on behalf of the claimants/respondents submits that one cross appeal being COT 10 of 2017 has been filed in this matter.
In view of disposal of the present appeal, the cross appeal is also disposed of.
Department is directed to tag the cross appeal along with the present appeal.
There shall be no further order as to costs.
LCR, if any may, be returned back to the Court below.
