1. The petitioner alleges that there is encroachment in public land. Learned counsel appearing for the private respondent submitted that a personal dispute is sought to be camouflaged as a Public Interest Litigation. Be that as it may, if there is any encroachment in a public land, the same should be prevented and the land should be restored as a public land.

2. Therefore, without going into the merits of the matter, there will be a direction to the 3rd respondent, the Assistant Engineer (Building), Howrah Municipal Corporation to conduct an inspection after notice to all concerned and proceed to take action in accordance with law as expeditiously as possible but preferably within a period of four weeks from the date of receipt of the server copy of this order.

2. In the light of the above, the writ petition stands disposed of.
