4 & 5 The petitioner claims to be a retired employee of the Mekhyada Anchalik S.K.U.S. Limited. His terminal benefits are due and payable. The petitioner submits that apart from his terminal dues certain advance payment made by him to the Society is also due and pending.

Learned advocate representing the Cooperative Societies submits that the claim of the petitioner will be looked into.

Learned advocate representing the Registrar of Cooperative Societies raises an issue with regard to the maintainability of the writ petition before this Court.

Prima facie, it appears that the petitioner claiming to be an employee of the Cooperative Society may have certain grievance with his employer being the Society. The writ petition ought not to be entertained for settling service dispute between the employer and the employee.

Since the Society has voluntarily expressed its willingness to look into the grievance of the petitioner, accordingly, without entering into the issue as to whether the writ petition is maintainable or not, the instant writ petition is disposed of by directing the Special Officer being the respondent No. 2 herein to decide the grievance of the petitioner in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. If any amount is found due and payable, the same shall be disbursed in favour of the petitioner at the earliest.

The writ petition is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
