1. This is the second occasion when none appears for the appellants in both the appeals at the time of call, although the respondents are represented through their learned counsel.

2. Learned senior counsel appearing for the respondents submits that as per the request of the court, intimation was sent to the learned Advocate for the appellants.

3. However, the said learned Advocate indicated that despite repeated reminders, his clients are not contacting him and as such, he is not inclined to appear in these matters.

4. As such, it is evident that the appellants are not interested to move the appeals or the connected applications.

5. Accordingly, FA No. 139 of 2009 along with CAN 4 of 2016(Old No: CAN 11869 of 2016), CAN 5 of 2016(Old No: CAN 11871 of 2016) and CAN 6 of 2019(Old No: CAN 12145 of 2019) as well as FA No. 379 of 2009 along with CAN 1 of 2008(Old No: CAN 8025 of 2008), CAN 3 of 2008(Old No: CAN 10867 of 2008), CAN 7 of 2016(Old No: CAN 11870 of 2016), CAN 8 of 2016(Old No: CAN 11872 of 2016), CAN 9 of 2019(Old No: CAN 12142 of 2019) are dismissed for default.

6. Interim orders, if any, stand vacated.

7. There will be no order as to costs.

8. In the event the trial court records have arrived before this Court, the same be sent down immediately to the trial court.
