This relates to a prayer for expeditious disposal of a pending case No. N 34/2019 of Learned Additional District and Sessions Judge, 6th Court, Barasat, North 24 Parganas (Special Court) under NDPS Act.
Mr. Chakraborty, learned advocate representing the petitioner submits that the petitioner is in custody, since 30th June, 2019, for the alleged recovery of 12 litres of codeine mixture. According to Mr. Chakraborty since the petitioner is in custody, the case of the petitioner needs to be disposed of expeditiously.
Mr.
Ganguly, learned advocate representing the State/opposite party, submits that court has already fixed dates for collection of the evidence after framing the charge on 14th November, 2019.
Having considered the submissions of the both parties that some of the dates went frustrated sometimes before the intervention of the Covid situation, and even after the intervention of the Covid and the impact of Covid situation
disturbing the ordinary function of the court to a large extent, the revisional application may be disposed of, so as to subserve purpose of justice, as proposed to be obtained by the petitioner, by passing the following direction. The learned court below is directed to proceed with the trial expeditiously so that the date so scheduled could be effectively utilized taking the sincere support from the Public Prosecutor conducting the trial and reach the logical conclusion of the case providing sufficient opportunities of hearing to the parties to the case.
With the aforesaid observation the revisional application is disposed of.
