1. Similar matters involving identical questions of law have been decided by a Coordinate Bench on 28th August, 2023 in MAT 1281 of 2022 (The State of West Bengal & Ors. Vs. Bharat Ghosh & Ors.).

2. The Coordinate Bench allowed the appeal upon condoning the delay. On the basis of the same reasoning, the appeal and the applications are allowed. The delay is condoned.

3. The affidavit-in-reply and the affidavit-ofservice filed in Court today are kept with the record.
