Mr. Soumitra Bandyopadhyay Mr. R. C. Guchhait ...for the State.

Affidavit of service filed by the petitioner be taken on record.

Heard learned counsels for the parties.

The petitioners claim to be in possession of vested land by raising construction of residential house therein for more than 22 years. The petitioners complain that long term lease in the form of patta has not been granted in their favour by the State authorities despite several communications being made with the authorities. The petitioners seek liberty to submit a comprehensive representation before the State authorities in this regard and pray for a direction upon the authorities to consider the representation at the earliest.

Learned counsel for the State respondents submits that such representation be considered by the competent authority within a stipulated period of time. In view of the above, the writ petition is disposed of with liberty to the petitioners to submit a comprehensive representation before the 4th respondent within fortnight from date. The 4th respondent shall consider and dispose of the representation within three months from the date of receipt thereof after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

With the above observations and directions this writ petition being WPA 686 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
