Criminal Revisional Jurisdiction 20-02-2024 Subha Item no. 43 Ct no.34 CRR 124 of 2024 Abdul Barik -versus- State of West Bengal Mr. Subhajit Chowdhury .....for the petitioner.

Affidavit of service so filed be kept with the record. Learned advocate for the petitioner has prayed for expeditious disposal of Dum Dum Police Station Case no. 617 of 2019 dated 22-07-2019 which is pending before the learned Special Judge, Barrackpore(NDPS Act) being numbered as N-95 of 2019. Learned advocate submits that charge has been framed on November, 2022 and in spite of 9 schedule being fixed, no witness has been examined till date and the prosecution intends to rely upon 10 witnesses in order to prove its case. Having considered that the case was registered on July, 2019 and more than four and half years have passed since the intiation of the case, I direct the learned trial court to fix a schedule consisting of three dates and fix such schedule once in every two months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case, if any of the witness is not appearing or reluctant to appear, be it independent witness or a departmental witness, the

learned trial court will communicate with the Superintendent of Police/Commissioner of Police of the concerned District who would take steps for ensuring the presence of the witness on the dates so fixed before the learned trial court.

No unnecessary adjournments should be granted to either of the parties.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 124 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
