The department reports dated January 30, 2025 shows despite there being repeated opportunity granted, the appellants has not taken any steps in the matter. The paper books have not yet been filed within time frame directed by this court.

In view of the above, the instant second appeal S.A. 495 of 1994 stands dismissed for default, without any order as to costs.

Interim order, if any, stands vacated.

The Trial Court record, if arrived before this court shall be returned before the jurisdictional Trial Court

forthwith but positively within a period of two months from date.
