1. This is the third instance that the matter has been called on, as earlier, none appears on behalf the petitioner.

2. Mr. Basu Mallick, learned Advocate appearing for the State, submits that the challenge to the tender by way of the instant writ petition has become infructouous, inasmuch as the tender has already been given effect. The work order issued and work is underway.

3. In view of the aforestated, the writ petition has lost its force and is, accordingly, dismissed.

4. There shall, however, be no order as to costs. 5.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
