The petitioner has assailed the order dated 15th February, 2024 passed by the learned Additional Chief Judicial Magistrate, Kalyani, Nadia in GR 466 of 2017.

The order impugned demonstrates that the warrant of proclamation and attachment has been issued against the petitioner and others simultaneously upon compliance with Section 83(1) of the Code of Criminal Procedure.

However, the petitioner undertakes to surrender before the learned trial Court within seven from date. If the petitioner surrenders before the learned trial Court within seven days from date and files an application for bail, the learned trial Court shall deal with the same in accordance with law.

In the event the petitioner fails to surrender before the learned trial Court within the stipulated time frame, the learned trial Court shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court.

The order dated 15th February, 2024 be stayed till 13th March, 2025. CRR 189 of 2025 is disposed of.
