The petitioner alleges that despite the petitioner having lodged complaints, inter alia under Section 498A of the Indian Penal Code, no step has been taken by the police for arrest of the miscreants. Learned counsel appearing for the Staterespondents files a report which indicates that, pursuant to the complaints of the petitioner, a First Information Report was registered and investigation is duly going on. It has been stated in the report that, at least on five occasions, raids were conducted to arrest the accused persons, but without result. In the meantime, four of the private respondents, namely, Marjina Begum, Karuna Begum, Amina Begum and Reksona Begum have obtained anticipatory bail. It is
submitted that the police are making all endeavour to arrest the remaining two accused persons who are still absconding.
Learned counsel for the petitioner alleges that the said accused persons are roaming around in the neighbourhood, but the police are deliberately not taking any steps in that regard. However, the writ petition does not contain any specific pleading to that effect but merely alleges police inaction and that the accused persons are at large.
Keeping in view the police report, it would be premature to observe that the police are not taking adequate steps regarding the investigation-inquestion.
The police report filed in Court today be kept on record.
WPA 901 of 2021 is disposed of by granting the petitioner liberty to approach the appropriate court in the event the investigation is not completed satisfactorily within a reasonable time.
There will be no order as to costs.
