G.S.Das Mr. S. K. Humayan Reza ... for the Petitioner(s) The petitioner has approached this Court at a stage when the investigation of Raninagar P.S. Case No. 168 of 2021 dated 06.04.2021 under the provisions of 341/326/307/302/34 of the IPC and Section 3 and 4 of the ES Act was under progress.

Earlier, in connection with the instant case, the petitioner preferred a writ petition wherein a Co-ordinate Bench in WPA of addressed the grievance of the petitioner regarding returning to his village.

The present case has been preferred by the petitioner with a prayer

that as his complaint was not taken into consideration, there may be transfer of the said investigation.

Since the criminal case which has been referred to is of the year 2021 and the petitioner is unable to apprise this court regarding the latest stage of the case and/or the investigation, I am of the view that the petitioner would be at liberty to approach the jurisdictional court in seisin of Raninagar P.S. Case No. 168 of 2021 dated 06.04.2021 to ventilate his grievances.

With the aforesaid observations, WPA 780 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
