Learned advocate appearing for the petitioner submits that the petitioner is in custody for 55 days and has been arraigned because of statement of co-accused. The subjectmatter of the case also relates to recovery of 117 bottles of phensedyl.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there is antecedent of the present petitioner and his prayer for anticipatory bail was rejected pursuant to which he surrendered and was taken into custody by the learned Special Court.

I find that the offences complained of in respect of the antecedent are of the year 2020 and under the provisions of the Indian Penal Code and The Explosive Substances Act. Having considered the same and the principal accused

having been released on bail, I am of the view that further detention of the present petitioner is unwarranted in the facts and circumstances of the case. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Rahul Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional District and Sessions Judge, 5th Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court.

The application for bail, being CRM (NDPS) 102 of 2026, is, thus, disposed of.

Report submitted by the learned advocate appearing for the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
