Case No.2616 of 2023 presently pending before learned Chief Judicial Magistrate, Murshidabad.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the FIR was lodged on 12th June, 2023 and after completion of investigation police has submitted charge sheet on 24th June, 2023. Since then the matter is pending for framing of charge and the next date is fixed on 6th May, 2026. He further submits that prosecution has proposed to examine six witnesses. He prays that a direction may be passed to the Court below for expeditious disposal of the said criminal proceeding.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer, the opposite party will have no

cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.

Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is justified in terms of long pendency of the matter, the instant application being CRR 193 of 2025 is hereby disposed of with a direction upon the Court below to make best endeavour for expeditious disposal of the criminal proceeding and to make its best effort to conclude the trial preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties.
